CAMELBACK RESORT Season Pass Sweepstakes with the Loft GIVEAWAY OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: Giveaway (the “Giveaway”) is open only to those who sign up at the online Giveaway page and who are 21 years of age as of the date of entry. The Giveaway is open only to legal residents of the fifty (50) United States and District of Columbia, and is void where prohibited by law. Employees of Camelback Resort (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Camelback Resort, as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.

3. Giveaway Period: Entries will be accepted starting on or about December 1, 2023 and ending December 15, 2023. All entries must be received by December 15, 2023 11:59PM EST.

4. How to Enter: The Giveaway must be entered by either purchasing an unlimited or value season pass by December 15, 2023 11:59PM EST or through a mail-in-entry. Mail-In Entry Option: To enter the Giveaway without making a purchase or participating online, you may submit an entry via mail. Please follow the instructions below to enter by mail:

• Handwrite your full name, complete mailing address (including city, state, and ZIP code), email address, and phone number on a 3×5 inch card.
• Place the card in an envelope with proper postage affixed. The envelope should be addressed to:

• Mail the entry to the above address. Entries must be postmarked by the deadline specified in the official rules and received within seven (7) days of the deadline to be eligible.

Please note the following:

• Limit one (1) entry per envelope.
• Each entry must be mailed separately.
• Illegible, incomplete, or late entries will not be accepted.

By entering via mail, you acknowledge that you have read and agree to abide by the official rules of the giveaway. Mail-in entries become the property of Camelback Resort and will not be returned. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Camelback Resort. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Camelback Resort. By participating in the Giveaway, you acknowledge that the Giveaway is in no way sponsored, endorsed or administered by or associated with Instagram, Facebook, or Meta.

5. Submission Terms. By entering this Giveaway, you represent and warrant that your submission does not violate any third party’s proprietary or intellectual property rights. If your submission infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Sponsor. If the content of your submission is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. In addition, you agree to indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

6. Prizes: Winners will receive a $1,000 shopping spree at The Loft located at 1824 Sullivan Trail, Tannersville, PA.

Total ARV of all prizes: [$1,000]. Sponsor, in its sole discretion, reserves the right to substitute prize(s) of equal or greater value if an advertised prize become unavailable. Sponsor’s determinations regarding the awarding of prizes is final. No prize substitutions except as provided herein. Prizes are not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value. Any and all other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided, are the sole responsibility of the winner, including, without limitation, all federal, state, and local taxes, additional transportation and meals, luggage fees, gratuities, and souvenirs. For any prize over $600 in value, the potential winner will be required to complete and sign an IRS Form W-9. In compliance with US IRS regulations, Sponsor will send a Form 1099-MISC to any winner receiving a prize valued in excess of $600 (USD), which requires disclosure to Sponsor of winner’s social security number. Winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in winner’s state of residence. If a potential winner cannot be contacted using the information provided or fails to respond to Sponsor’s attempt to notify them of selection within two (2) days of first attempted notification; if any notification is returned as undeliverable; if Sponsor is unable to verify potential winner’s eligibility; if potential winner fails to sign and return the required documentation within the required time period or fails to comply with these Official Rules; if any prize is returned undeliverable; or if the potential winner cannot be verified as eligible for any other reason, the potential winner is disqualified and an alternate winner may be selected. Winner and all of winner’s guest(s) may be required to sign one or more liability release agreements before being allowed to participate as winner’s guest on a trip. Winner and their guest will be solely responsible for all air and ground transportation, for the purchase of any items of a purely personal nature, for the payment of any incidental expenses, and for the payment of any taxes, charges, and/or fees.

7. Odds: The odds of winning depend on the number of eligible entries received.

8. Winner selection and notification: Winners of the Giveaway will be selected in a random drawing under the supervision of the Sponsor. Winners will be notified via email within five (5) days following the winner selection. Camelback Resort shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

9. Rights Granted by you: By entering this content you understand that Camelback Resort, anyone acting on behalf of Camelback Resort, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

10. Terms: Camelback Resort reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Camelback Resort may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Camelback Resort. Camelback Resort reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.

Camelback Resort has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Camelback Resort reserves the right to seek damages from any such person to the fullest extent permitted by law.

11. Limitation of Liability: By entering you agree to release and hold harmless Camelback Resort and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

12. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.

13. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Camelback Resort Web Site. To read the Privacy Policy, click here. Without limiting the generality of the foregoing, Sponsor may retain for a reasonable period of time, personal information submitted in order to enable it to send that participant any prize that they have won and to verify that these Official Rules have been complied with, and for accounting purposes.  This data may be passed to a third party to enable such third party to fulfill any necessary requirements relating to the award of a prize. Any other use of personal information will be in accordance with, and subject to, the Privacy Policy.  Participant may have the opportunity to opt in to receive emails or other communications from third parties. In the event that participant opts in to any available opportunities to receive information from a third party, that may or may not be associated with this Giveaway, participant understands and acknowledges that his/her information will be provided to such third party and may be used by the third party as set forth in the third party’s privacy policy. Any available opt-in opportunities are not required to enter the Promotion, and opting in will not improve your chances of winning.
